Open Access to Courts

The Oklahoma Supreme Court released its second opinion of 2010, and boy was it kind of a shocker to me.
The case is Fent v. State ex. rel. Department of Human Services, 2010 OK 2, and addresses the issue of whether 28 O.S. § 152(D)(E) and (F) as well as 28 O.S. § 152.1(B) are constitutional [...]

Mommy Bloggers Beware

The Federal Trade Commission has a new rule in place that requires all bloggers to disclose any financial incentives they receive for endorsing products or services. The new rules takes effect on December 1, 2009.
I think this is a stupid rule, but who am I to judge? After all, what person doesn’t realize that someone [...]

Thank Your Local Legislature

Tomorrow (November 1, 2009), a lot of the protections offered to Oklahoma’s injured parties and consumers will disappear. During this past legislative session, several of the laws related to personal injuries and consumer rights changed. I believe many of them are bad changes, and will lessen the access many people have to redressing their injuries.
Here’s [...]

I Hope You’re Just as Sick

A coworker turned me onto this website’s story about 8 of 50 states that still allow insurance companies to deny benefits/coverage to women who are victims of domestic violence.

The only thing I hate more than guys who beat their wives/girlfriends is guys who molest young kids. This kind of treatment (discrimination?) towards particular groups of [...]

Oklahoma’s Tort Reform Issue

Here’s a great blog post by San Diego attorney, Ross Jurewitz, on the tort reform issues that are brewing here in Oklahoma. I agree emphatically with his arguments.

You can read my opinions here.

Examine the Fine Print

A potential client recently visited with me regarding an interesting issue he’s dealing with.

This man rented a vehicle from a national vehicle rental company because his personal vehicle needed some repair work. The repair shop, his insurance carrier, and the car rental company all share a building.  The man signed the standard rental contract, [...]

Tort Reform (Negative) 2.0

It seems like every time the economy goes bad, or every time there’s a new Congress or legislature, there’s also heavy talk of "tort reform."

Generally, Republicans favor tort reform because it "benefits businesses", while Democrats dislike the idea because you’re permitting bad products/people. I’ve never really understood this, because both sides seem to be [...]

We Need Tort Reform, But Not Like This!

We’re physiologically and psychologically geared towards getting the best deal possible. We haggle at the yard sales, search the internet for the lower price, and drive miles to purchase a watermelon or some other insignificant thing we find cheaper somewhere else. The same goes for products or services, everyone hates paying too much for a [...]

Give Me My Bailout

I‘m a pretty laissez-faire type of guy when it comes to people, businesses, etc. My general belief is that you get what’s coming to you depending on the type of work (not employment, but ethic) that you have. I like to believe that the "American Dream" (i.e. success through hard work, good morals, and honesty), [...]

Prepare for Another Bailout

The Washington Post has a story quoting Vice-President Biden on Sunday’s Face the Nation. Biden is quoted as saying that the banks may need more money to save them from this financial downturn. We’ve already discussed the ramifications of these bailout measures, and some news services are even reporting that the money these banks are [...]
